Mr. Chairman,
My delegation thanks you for the diligent manner in which you have continued to steer the work of this committee. We also commend those countries that have made an input to these discussions by submitting their positions to the Secretary General.
Mr. Chairman,
Kenya welcomes the adoption by the International Law Commission of the draft articles on diplomatic protection on the second reading at its fifty-eighth session last year. We commend the Special Rapporteur, John Dugard for guidance to the Commission during the exercise.
Mr. Chairman,
It is approximately 10 years since the topic was first identified as suitable for codification. Kenya supports the recommendation that the General Assembly elaborate a convention on the basis of the draft articles on diplomatic protection. The adoption of an instrument will codify customary practices, promote legal clarity on applicable rules of practices of states and promote progressive development of international law on the subject.
Mr. Chairman,
My delegation is therefore of the view that the General Assembly should remain seized of this matter, to sustain the necessary momentum towards the conclusion of a convention.
